Leasing Authority - Code Extraction

The Department of Administrative Services (DAS) leasing program is composed of three elements; lease all buildings and office space at the seat of government 8A.321 (6a), coordinate leasing throughout the state and promote the collocation of state agencies 8A.321 (6c).  Each of these areas can be analyzed separately to determine the best methods to provide services.

Leasing at the seat of government.

Leasing in Des Moines provides these basic functions for all state agencies; space for agencies for the delivery of services to residents of Des Moines and Polk County, space for agencies for which there is insufficient space on the Capitol Complex, space for agencies in need of temporary space. Focuses of customer service should be; an up to date data base of possible space in the Des Moines area, an up to date data base of state leases in Des Moines, appropriate contact with the agencies to be aware of their projected needs, space available to meet un-forecast needs, and appropriate methods to pay for leases.

Leasing throughout the state.

Leasing throughout the state provides these basic services for all supported agencies; standard state lease, filter point for submittal of all leases to the executive council for approval, data base of all leases, and other services requested.  Other services can include legal review of leases, data base of available lease space, and requests for proposals (RFP).  Additional services can be provided as requested, and for which agencies are willing to pay.  Discussions following the leasing request for strategies indicated that agencies are reluctant to pay for any additional services.  Approval of all leases by the Executive Council is based on an executive order for Americans with Disabilities Accessibility Act Guidelines (ADAAG) compliance and a letter to all departments requiring use of our standard lease, an ADA evaluation on all leases and Executive Council approval.

Collocation of state agencies.

Leasing provides for the identification of existing leases and the availability of space at those locations for interested agencies. Data bases in the seat of government and throughout the state for both supported and non-supported agencies allows for this service. Services for leases outside Des Moines have included RFPs, lease negotiation, tenant build out management, move management and management of landlord support.

Future services.

As part of any change in services, one of the first steps needs to be meetings involving the leasing coordinators of the agencies we support. Changes to services should be based on items that agencies want, can be supported by Department of Administrative Services, and have a value added, both real and perceived.

8A.321 (6a). Lease all buildings and office space necessary to carry out the provisions of this subchapter or necessary for the proper functioning of any state agency at the seat of government.  For state agencies at the seat of government, the director may lease buildings and office space in Polk county or in a county contiguous to Polk county.  If no specific appropriation has been made, the proposed lease shall be submitted to the executive council for approval.  The cost of any lease for which no specific appropriation has been made shall be paid from the fund provided in section 7D.29.

8A.321 (6b). When the general assembly is not in session, the director may request funds from the executive council for moving state agencies located at the seat of government from one location to another. The request may include moving costs, telephone costs, repair costs, or any other costs relating to the move. The executive council may approve and shall pay the costs from funds provided in section 7D.29 if it determines the agency or department has no available funds for these expenses.

8A.321 (6c). Coordinate the leasing of buildings and office space by state agencies throughout the state and develop cooperative relationships with the state board of regents to promote the collocation of state agencies.
